Contest & Giveaway Official Rules

1. Eligibility: Mario Badescu Skincare ‘Consumer Competition’ ("Sweepstakes") is open to persons who are legal residents of, and physically located within, the United Kingdom, and thirteen (13) years of age or older at time of entry. Entrants aged 13-17 must have consent from a parent or legal guardian to enter and, if selected as winner, must be accompanied by their parent or legal guardian as their guest. Void where prohibited. All federal, state and local laws and regulations apply. Employees of the Sponsor - Mario Badescu Skincare and its affiliates, subsidiaries and advertising and promotional agencies, judges, and the immediate family members (herein, defined as spouse, siblings, children and each of their respective spouses, regardless of residence, and any person living in such a person's household, whether related or not) of each, or of any company affiliated with the Sweepstakes and collectively with the foregoing persons or entities ("Sweepstakes Entities"), are not eligible to participate.

 

2. Entry Period: Sweepstakes begins at 12am Eastern Standard Time ("EST") on March 24, 2025, and ends at 11:59pm EST on April 28, 2025.
   NO PURCHASE NECESSARY AND NO ENTRY FEE, PAYMENT OR PROOF OF PURCHASE IS NECESSARY TO PARTICIPATE.

 

3. How to Enter: To be entered into sweepstakes, contestants must:

1. Repost the consumer giveaway post from @MarioBadescu to your stories

2. Tag @mariobadescuuk and @bootsuk

3. Tag a friend you would like to take on the NYC trip

4. Use the hashtag #MBGetMeToNYC

5. Follow @mariobadescuuk and @bootsuk on Instagram

●       IG details: You must be following @mariobadescu. @mariobadescuuk and @bootsuk on Instagram at both (i) the time of entry and (ii) the time of any applicable drawing for such additional entry to be eligible.

●   You may receive a maximum of one (1) entry in the Sweepstakes.

●   Compliance with the entry requirements will be determined by Sponsor in its sole discretion. Entries that do not comply with these entry requirements, as determined by the Sponsor in its sole discretion, or that do not meet the entry deadlines, will be disqualified from the Sweepstakes.

●   Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules.

●   Each winner is subject to verification, including verification of age and residency. 

●   All entries must comply with Instagram's community guidelines. Entries violating these will be disqualified.

 

4. Random Drawing and Notification: One (1) potential winner will be selected by random drawing. Winner will be selected under sole discretion by a third party within 5 (five) days of the competition closing date and will be contacted via Instagram DM. The winner must respond within 2 (two) working days to claim the prize using the contact information given at the time of entry. Odds of winning depend on the number of entries received. Sponsor is not responsible for any change of email address, mailing address, and/or telephone number of entrants. Prize forfeiture may result from any of the following: if a winner (i) is determined to be ineligible or otherwise disqualified by Sponsor, (ii) fails to respond to Sponsor’s first winner notification message within 24 hours of notification or after two (2) attempts (whichever occurs first), (iii) fails to timely provide any information requested by Sponsor (e.g., information needed by Sponsor to deliver the prize) or timely execute and return any documents required by Sponsor to accept the prize, (iv) winner is otherwise found to be ineligible, (v) winner cannot accept or receive the prize for any reason, or (vi) any other non-compliance with these Official Rules, then in each instance such winner will be disqualified and forfeit all interest in the prize. If a winner is disqualified, Sponsor reserves the right to either (A) select a substitute winner through a random drawing or (B) not award the unclaimed prize, in Sponsor’s sole discretion. Once potential winner's eligibility is verified, he/she will be confirmed as a winner. Prize will be sent to the winner approximately thirty (30) days from the date winner is confirmed before it is considered forfeited. The Sponsor is not responsible for any returned undeliverable prize and such prize will be forfeited. All income taxes resulting from acceptance of prize are the responsibility of winner. By entering this sweepstakes, entrant accepts and agrees to these Official Rules and the decisions of the Sponsor, which shall be final in all matters. Acceptance of a prize also constitutes permission to use winner's name, and likeness and social media account for marketing purposes without further compensation or right of approval, unless prohibited by law. All federal and state laws apply.

 

5. Prize and Its Approximate Retail Value ("Arv"):

Prize Winner will receive a 3-day/3-night trip for the Winner and one (1) guest to New York City. The prize includes: Round-trip economy flights for the Winner and one (1) guest to New York, NY area airport from a major commercial airport in the UK, travel insurance, 3-day/3-night hotel accommodations (one standard room, double occupancy) in a hotel of Sponsor’s choice in the New York City area; round-trip transportation to and from New York area airport and hotel; round-trip transportation for Winner at (1) guest for private tour of Mario Badescu headquarters in Edison, New Jersey; a personalised election of Mario Badescu skincare products (Valued over $100); one (1) $200.00 Gift Card to dine at New York City restaurant of Sponsor’s choice which may be used by Winner and (1) guest (or used otherwise). The total approximate retail value (“ARV”) of the Prize awarded in this Sweepstakes is $3,000.00 USD. The ARV represents the Sponsor’s good faith determination of the maximum retail value thereof.

Odds of winning a prize will depend on the number of eligible Entries received during the Entry Period. Prizes pictured in advertising, marketing or promotional materials are for illustrative purposes only. Prize consists of only those items specifically listed as part of the prize. Any applicable taxes and all other costs/expenses not specifically identified in these Official Rules are the sole responsibility of the winner. Actual value of trip prizes will depend on airfare fluctuations and point of departure. Any difference between stated value and actual value will not be awarded. Travel must be completed by 12/31/2025. Winner and guest must travel on same itinerary. All travel accommodations and arrangements at sponsor's discretion. Certain blackout dates and restrictions apply.

Prize is non transferable, and no substitutions or cash redemptions will be made, other than as provided herein. Limit one prize per family or household. No substitution or transfer of prize permitted by winner. Sponsor reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason. Any applicable taxes and all other costs/expenses not specifically identified in these Official Rules are the sole responsibility of winner.  All costs and expenses associated with prize acceptance and use not specifically provided herein are the responsibility of the winner. Any details of prizes not specified will be determined by Sponsor in its discretion. Winner's guest must be 18 years of age or older, unless the winner is the parent or legal guardian of the guest.

6. Publicity. Except where prohibited by law, by accepting a prize, the winner hereby grants Sponsor and each of their representatives an irrevocable, perpetual, worldwide, royalty-free, non-exclusive and sub-licensable right and license to use, distribute, and publicly display the winner’s name, Instagram handle and information about the prize award, in any way, at any time, in any and all media, including without limitation, for use in advertising and marketing, without any additional approval or consideration. By accepting a prize, the winner represents and warrants that he or she has the right to grant the foregoing license. By submitting content for the contest, participants confirm that it is their original work and that they own all rights to the content, including but not limited to music, sounds, and videos.

 

7. Limitations of Liability of Sweepstakes Parties:

 

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE (I) THE SWEEPSTAKES PARTIES SHALL NOT BE RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES ARISING OUT OF OR CONNECTED WITH (A) THE SWEEPSTAKES OR (B) ANY PRIZE AWARDED, AND (II) YOUR REMEDIES FOR ANY CLAIMS RELATING THE SWEEPSTAKES ARE LIMITED TO YOUR ACTUAL OUT-OF-POCKET EXPENSES OF PARTICIPATION IN THE SWEEPSTAKES (IF ANY).  

 

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. 

The Sweepstakes Parties assume no liability and are not responsible for, and by entering the Sweepstakes you hereby waive and release the Sweepstakes Parties and Instagram from, any actions, claims, damages, losses or injuries of any kind (collectively “Claims”) arising in connection with the Sweepstakes and/or the receipt, use or misuse of any prize, including without limitation, Claims relating to: (i) the malfunction of any computer, telephone, mobile device, network, satellite, hardware, software or communications line; (ii) unauthorized human intervention; (iii) incorrect, delayed or inaccurate transmission, winner notifications, prize claims or other information or communications relating to the Sweepstakes, or the failure to capture or transmit any such information; (iv) damage to any person’s computer or mobile device; (v) late, incomplete, or incorrect entries; an entrant's failure to receive prize notices due to entrant's spam, junk e-mail, or other security settings or for entrants' provision of incorrect or otherwise non-functioning contact information; or (vi) any errors in these Official Rules, winner notifications or other announcements or communications relating to the Sweepstakes. In the event of any ambiguity or error(s) in these Official Rules, Sponsor reserves the right to clarify or modify these Official Rules however it deems appropriate to correct any such ambiguity or error(s). If due to an error or for any other reason, more legitimate prize claims are received than the number of prizes stated in these Official Rules, Sponsor reserves the right to award only a single prize from a random drawing of all eligible entries. In no event will more than the stated number of prizes (i.e., one prize) be awarded. If, in the Administrator's opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the sweepstakes, or if technical difficulties (including viruses and bugs) compromise the integrity of the sweepstakes, Sponsor reserves the right to cancel or modify this sweepstakes in a manner deemed appropriate by the Sponsor. In the event of termination, winners will be selected from among all eligible entries received as of date of termination. In the event a dispute arises as to the identity of a potentially winning entrant, entries will be declared made by the name on the online entry form.

 

LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND PURSUE ALL OTHER REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. 

 

8. Force Majeure. The Promoter will not be held liable for delays or failures due to unforeseen events (e.g., natural disasters, pandemics, or government restrictions).

 

9. Choice of Law and Forum: The competition is governed by English law, and entrants submit to the non-exclusive jurisdiction of the courts of England and Wales. For EU/UK residents, this choice of law does not deprive you of the protection afforded by provisions that cannot be derogated from by agreement under the law of your country of residence. Any legal suit, action, or proceeding arising out of or relating to this sweepstakes and these Official Rules may be brought in the applicable courts of England and Wales or your country of residence.

 

10. Privacy: Information submitted with an entry is subject to the Privacy Policy stated on https://www.mariobadescu.com/privacyinfo. By entering this competition, you acknowledge that your personal data will be processed in accordance with the General Data Protection Regulation (GDPR) and our Privacy Policy. We will only collect and process personal data that is necessary for administering the competition, including your name, Instagram handle, contact details, and any content you submit. Your data will be retained only for as long as necessary to fulfill these purposes and to comply with our legal obligations. You have the right to request access to, rectification or erasure of your personal data, restrict processing, object to processing and data portability. To exercise these rights or raise any privacy concerns, please contact our Data Protection Officer at privacy@mariobadescu.com. Your personal data may be transferred to the United States for prize fulfillment purposes, subject to appropriate safeguards including Standard Contractual Clauses as required by GDPR. You have the right to lodge a complaint with a supervisory authority in the EU/UK regarding the processing of your personal data.
